Wills/Estate
What is a Will? A Will is a legally enforceable written document that takes effect upon death, and directs the distribution of a person’s personal property and real estate. You need a Will because it ensures the orderly distribution of your assets according to your wishes.
Our office is available for the preparation of Outright Distribution Wills, Powers of Attorney and Advanced Directives (and/or Living Wills). These documents prepared by our experienced lawyers give valuable peace mind for the testator and their loved ones.
It is important to have a lawyer prepare your Will to ensure that it was properly phrased, witnessed and able to be admitted to “probate” in the future.
What is meant by “Probate”? Upon the death of the Testator (maker of the Will), the probate process can begin. This is the legal process that establishes the genuineness of the Will. It is done by the Surrogate in the County where the testator resided at the time of death. Although the process can begin any time after death, the Surrogate cannot issue Letters until the 11th day after the death of the decedent. This time allows for a caveat (a notice given by an interested party to stop the probate of a will or issuance of letters of administration) to be filed with the Surrogate.
