NAME CHANGES
N.J.S.A. 2A:52-1 et seq. governs actions for changes of name in the State of New Jersey. Pursuant to the statute, "any person may institute an action in Superior Court, for authority to assume another name."
In order to change one’s name, a Judgment authorizing a name change must be obtained from the Superior Court. To obtain a Judgment (like any other Judgment), a Complaint must be filed. The Court is then permitted to enter a Judgment authorizing a name change provided the action is not being instituted for purposes of avoiding or obstructing criminal prosecution or for avoiding creditors or perpetrating a criminal or civil fraud.
Procedurally, obtaining a Judgment for a Name Change can be overwhelming. Upon the filing of the Complaint, the Court typically schedules a hearing not less than 30 days from the date of the Order. At least two weeks prior to the hearing, a legal notice of the application for a name change must be published in a newspaper of general circulation in the county where plaintiff resides.
On the date fixed for a hearing, if the court is satisfied from the papers filed, with or without oral testimony, that there is no reasonable objection to the assumption of another name by the Plaintiff, the Court shall by its judgment authorize plaintiff to assume such other name from and after the time fixed therein, which shall not be less than 30 days form the entry thereof. Although upon obtaining the Judgment it may seem that the process is now complete, procedurally you are still a few steps away from completing the name change.
Within 20 days after the entry of judgment, a copy of the Judgment for Name Change (social security numbers redacted) must be published again in a newspaper of general circulation in the county of plaintiff’s residence. And within 45 days after entry of judgment, the unredacted judgment and affidavit of publication of the judgment must be filed with the deputy clerk of the Superior Court in the county of venue and a certified copy of the unredacted judgment shall be filed with the appropriate office within the Department of Treasury.
