Criminal
The Superior Court of New Jersey has jurisdiction over Indictable Offenses committed within our State. Indictable Offenses are what is more commonly known as "Felonies". Indictable Offenses carry varying degrees depending on the severity of the offense (First Degree, Second Degree, Third Degree, and Fourth Degree). Each degree carries with it a certain State prison sentence which is found within the Sentencing Guidelines. For example, a First Degree offense typically carries a 10 to 20 year sentence, Second Degree carries a 5 to 10 year sentence, Third Degree carries a 3 to 5 year sentence and Fourth Degree carries a sentence of up to 18 months. Certain offenders with prior criminal records are also subject to mandatory sentencing enhancements subjecting them to even longer sentencing.
Our office has represented individuals facing significant State prison time for varying criminal offenses. For example, our office represented an individual facing a First Degree Kidnapping Charge and Second Degree Aggravated Assault with enhancements exposing our client to a possible State prison sentence of up to 55 years. In that particular case, after several Motions and Status Conferences, our aggressive and diligent representation of this individual resulted in a sentence of only "time served".
It is important to know and understand your rights if detained, if arrested, charged with a crime. Our Attorneys and Former Prosecutor will protect your rights throughout the legal process and will be able to effectively identify and exploit deficiencies in the State’s case in order to pursue the best possible results for you. An experienced and aggressive defense attorney can mean the difference between a mandatory prison sentence, an acquittal or "time served". If you also have issues regarding your immigration status, it is important to retain the services of one of our attorneys who is experienced in both criminal and immigration law and comprehends the collateral effects of being found guilty or pleading guilty to an amended charge. Our office will advise you if you may be eligible for probation or pre-trial intervention thereby foregoing the effects of a criminal conviction.
